FOI Request - Accident - Trinity Place, Elgin Town Hall - Review

To date we have not received the requested information.

For clarity, the below request relates to a Freedom of Information request. This request covers;

1. Any maintenance records relating to the manhole cover at Trinity Place;
2. Copies of all repair documentation regarding the manhole cover on Trinity Place;
3. Copies of any complaints regarding the manhole;
4. Copies of any investigation reports regarding the manhole;
5. Copies of any information regarding who is responsible for the maintenance of said manhole.

Please confirm whether the council holds any of the above information, specifically complaints. Regardless of whether Scottish Water are responsible for the manhole cover, Moray Council will record any complaints and have a legal duty to advise Scottish Water of any complaints made.

Response 07-12-2015

1. Moray Council has no access to maintenance records for a third party asset. As this information is not held it is therefore exempt under Section 17 of the Freedom of Information (Scotland) Act 2002.

2. Moray Council has no access to repair documentation for a third party asset. As this information is not held it is therefore exempt under Section 17 of the Freedom of Information (Scotland) Act 2002.

3. No recorded complaints for this manhole prior to an incident reported on 1 August 2015. Retrospective record of call  log for this incident is attached here and here. This call was closed off by Moray Council as referred to a third party, Scottish Water at 12:45 on 1 August 2015 (Call Ref 5440482).

4.Moray Council has no access to investigation reports for a third party asset. As this information is not held it is therefore exempt under Section 17 of the Freedom of Information (Scotland) Act 2002.

5.Moray Council do not keep records for third party assets, but believe this manhole to be a Scottish Water asset. As this information is not held it is therefore exempt under Section 17 of the Freedom of Information (Scotland) Act 2002.
