FOI Request - Mini-competition: Equipment Framework (PS-12-008-01)-The Provision of Office Equipment

We refer to the above mini-competition procedure that was recently conducted by The Moray Council,
(the "Council") in respect of which, the winning tenderer was Xerox. This mini-competition was required
as a result of the Council's decision to terminate the previous mini-competition conducted through the
Scottish Procurement Framework on or around 12th June, 2015. For ease of reference, we refer to the
most recent mini-competition as 'Procurement 2' and the earlier mini-competition as 'Procurement 1'.
We would request the provision of the following information as soon as possible and in any event within 20 working days:

1. All written records (in whatever form) between Xerox and Moray Council between the date on
which Moray Council announced they were terminating Procurement 1 (around 12th June, 2015)
and the date on which the ITT for Procurement 2 was issued [10th November, 2015];

2. All written records (in whatever form) between Xerox and the Council between the
commencement of Procurement 2 [10th November 2015 and 27 January 2016);

3. All written records (in whatever form) which consider the number of and specification of devices
that should be included in the ITT for Procurement 2, including but not limited to consideration
of the need to change considerably the scope of the ITT from Procurement 1.

4.  All written records (in whatever form) regarding the evaluation of pricing submissions for
Procurement 2 including but not limited to consideration of the number of peripherals for each
device category that were to be evaluated.

5.  All written records (in whatever form) which evidence or consider compliance by Xerox of the
Council's requirement in Procurement 2 for all devices to be brand new (as per the Council's
statements on the bulletin board to this effect) to include all fleet devices and the VHV
Production Print Devices for the Print Services and the Design Works Departments;

6.  All written records (in whatever form) which evidence that Xerox's submission for Procurement
2 contained a fixed "Cost Per Page" for the term of the Contract or otherwise.

7.  Information from Xerox's submission on whether the Cost Per Page(s) quoted were conditional
on an agreed annual minimum volume per annum or over the term of the Contract;

8.Confirmation of the device model(s) proposed by Xerox in each of the 14 device categories
included within the ITT for Procurement 2.
