I would like to appeal your decision in relation to my Freedom of Information request to Moray Council on Self Directed Support - Reference: 101001285380 on the grounds that you have not met the terms of my request and supplied inaccurate information.
Point 1 of my request was "Please provide a copy of the latest internal council report on progress with Self Directed Support." In reply you provided me with a copy of a report dated 18th March 2015, more than 17 months prior to the date of my FOI request. This was on the grounds that you no longer produced a progress report.

Freedom of information requests can apply to all council documents, reports, letters and emails including those that take place between council employees or with officials of other bodies. We do not seek already published material which is available from your
website. The words "latest" and "internal" were included in the request because we are seeking an understanding of Self Directed Support Implementation from the perspective of your local authority.

Earlier in the summer of 2016 COSLA and the Scottish Government asked all councils to complete a survey report entitled "Survey of Local Authority Self-Directed Support Implementation" by the 11th of August 2016. This is likely to be the "latest internal" council report on this matter and we knew this when we wrote to your local authority. We expect your local authority to provide us with either a copy of this report or another report dated between 11th August 2016 and 22nd of August 2016 when you received our FOI request. Such documents are covered by Freedom of Information legislation and we expect you to meet your obligations by providing us with these.

Response 03-10-2016

Following your request for a review of our response to the FOI you submitted, 101001285380, a review meeting was held at the council offices on October 3rd 2016. In attendance were the Records and Heritage Manager, Senior Solicitor, Self Directed Support Development Worker and Information Co-ordinator.

It was agreed that the Council’s original decision is upheld; the information provided in response to question 1 of your original request is the latest internal council report on the progress of Self Directed Support and satisfies the original request.

Further to this, your review request detailed specific information you are seeking which is different to your initial request. The survey you refer to was an online form that was completed for the Scottish Government. As such we can advise under section 17 of the Freedom of Information Act 2002 that no copies of the information that was submitted are held by the Council.

Further queries regarding the survey should be directed to the Scottish Government, who we understand will be publishing a report on its findings in due course. Please see their website here for more information.
