In the event of an emergency/disaster within the area you cover (eg, plane crash, train crash, civil unrest etc) please can you provide me with any document(s) you may have in relation to how your organisation will respond - for example any emergency planning documentation etc.

Moray Council’s Emergency Planning Policy and Procedures are available on the Council’s website and are therefore exempt under section 25(1) of the Freedom of Information (Scotland) Act 2002. This details the way the Council will respond to any emergency which may affect the Moray area and includes its emergency management structure and how the Council will work with partners. For ease of reference please find a link to the web page here.

Further information is exempt under section 36 of the Freedom of Information (Scotland) Act 2002; confidentiality. The Council’s emergency response arrangement contains information provided by other bodies in circumstances which imposed an obligation on the Council to maintain that confidentiality.

In the interests of transparency, please see the below points:

  • The Council is classified as a Category 1 Responder under the Civil Contingencies Act 2004. The Act and information relating to it is publicly available.
  •  In Scotland, the Civil Contingencies Act 2004 (Contingency Planning)(Scotland) Regulations 2005 ("the Regulations") set out further detail on the application of the Act in Scotland, with particular regard to the duties and roles of responders.   • One of the key principles for emergency planning is plans are created to deal with consequences of emergencies and wherever possible generic arrangements are produced. 
  • The Council works in partnership with other Emergency Responders and the Voluntary Sector in developing plans relevant to the risks communities face. These plans range from generic Emergency Planning & Response Arrangements to incident specific and location specific plans.
