Accident involving a defect at Seafield Primary School, Elgin. Please find enclosed pictures of the defect of the said area, located adjacent to the assembly hall entrance.
We would be grateful if you would provide us with all documentation for 12 months prior to the accident (06-12-2016) including but not exclusively limited to the following, with personal details of all individuals other than the data subject redacted if necessary:
1. Inspection and maintenance records of said school grounds
2. Inspection records
3. Records of works instructions
4. Details of all parties who operated on a commercial capacity 12 months prior to December 2016 3 month after 6 December 2016
5. Photographs or CCTV footage of said accident
6. Previous accidents reports relating to the said defect
7. Previous complaints records regarding the said defect

1. We do not have any information for this question as the 4 Schools project began in July 2015 which saw the site (Seafield Primary) handed over to Morrison Construction for the works needed. All records and reports would be held by them. It is therefore they are exempt under Section 17 of the Freedom  of Information (Scotland) Act 2002- Information Not Held.

3. The major contract was awarded to Morrison Construction who commenced works in July 2015. This involved total refurbishment of the full school, while it remained operational. The risks of this were well documented in the H&S Plan and Morrison's were responsible for safe operation of the site. All works instructions are held by Morrison Construction therefore they are exempt under Section 17 of the Freedom  of Information (Scotland) Act 2002- Information Not Held.

8. We have sent the accident report directly to the requester as it contains personal information so would be exempt under Section 38(1)b of the Freedom of Information (Scotland) Act 2002- Personal Information. Further information from witnesses Fiona Grant, Senior Project Officer below:

This accident occurred on the 6th December 2016 and was witnessed by myself,  personnel from Morrison Construction, teaching staff, Marian Ogg (HT), Resources Officer  and Health and Safety Adviser John Watson. 

"The school was having a fire audit on this day with Fire Officer.  A fire test was run at approximately 11am and all staff and children evacuated to muster points.  All personnel involved in the audit including xxxxxxxxxxxxxx and xxxxxxxxxxxxxxxx also evacuated the building.  Everyone evacuated the building to the designated fire points as per fire plans which for visitor at the grassed area by the staff room.

When the drill had been satisfactorily completely The janitor went ahead to turn the alarms off.  He stumbled by the area at the base of the ramp adjacent to the gully pots which had been replaced and tarred by the groundwork contractor leaving a final small area to be completed when downpipes had been installed.

I was present when he stumbled and once I had ascertained he was ok went into the building.  It was then clear as we continued the audit that the janitor had sustained an injury and the Health and Safety adviser and the janitors line manager informed us he had twisted his ankle.

The project at Seafield commenced 1st July 2015.  Works have been on-going during that time and completed on the 31st March 2017.  The contractor is Morrison Construction Ltd.  There were no previous complaints regarding this area and no other accident reports.
