We would be obliged if you can provide us with the following details in regards to notices/Orders that have been made by Moray Council under the legislation listed above:
•Notices or Orders that remain extant as at 24th October 2017
•Notices or Orders that have been complied with and have monies owed to Moray Council as at 24th October 2017
•Notices or Orders that have invoices pending in respect of works carried out by or on behalf of Moray Council to resolve the matter as at 24th October 2017
If it is not possible for the details of outstanding monies to be confirmed we would be obliged if you can provide us with the following details:
•all notices served or orders made by Moray Council from 28th March 2017 to 24th October 2017 under the legislation listed above
When answering in the negative to any of the above, we would be obliged if you would confirm that you are doing so.
Wherever possible we would be grateful if the information could be prepared to include the following:
•?addresses of the subjects the actions are served over.
•?summary descriptions of the nature of the works/contravention.
•?status of the action.
•?amounts owed to the council (when available).
1) Notices or Orders that remain extant as at 24 October 2017 - To list the details of every Stopping Up Order we have on record is an unmanageable and unreasonable request. This is in line with similar previous FOI requests in which we have advised that we would need to manually trawl through our records to identify which are Stopping Up Orders rather than other types of permanent or temporary road traffic orders which have been implemented over time. We estimated that we hold approximately 1100 Orders, that it would take around 3 minutes per document over the process ay my hourly rate of £49.
2) I am not aware of any monies owed by the Council or any invoices pending in respect of any works carried out in connection with the Orders made under the legislation.
3) Orders made by Moray Council from 28th March 2017 to 24th October 2017 are as follows;
*S12 and S68 of the Roads (Scotland) Act 1984 - None.
*S207 and 208 of the Town & Country Planning (Scotland) Act 1997;
The Moray Council (Forres Railway Crossing – Mosset Road, section of Invererne Road and Core Path FR31– Stopping Up) Order 2016 - came into effect on 10th October 2017.
