Sections 28 - 30 of the Building (Scotland) Act 2003 provides enforcement powers to Local Authorities to ensure that buildings are maintained in a safe condition
It is, therefore, the responsibility of Building Standards to ensure that the building occupants, members of the public and
anyone in adjoining buildings are not put at any risk should a building become dangerous in any way.
This can be done by repairing or demolishing the building and also usually involves the provision of barriers around the danger. How quickly the work needs to be done depends on the severity of the danger after an assessment of risk.
It is the responsibility of the building owner to carry out any work, but in cases where the owner cannot be identified or found, or if the owner refuses to carry out the requested work, we may appoint a contractor and any costs will be charged to the owner.
Where a member of the public is concerned regarding the condition of a building, it should be reported to Building Standards for appropriate action.
