FOI Request - Large Scale Windfarms Objection

Extent to which Scottish public authorities which are statutory consultees under Section 36 of the Electricity Act 1989, object to large-scale windfarms (over 50MW in planned installed capacity) whether in or in close proximity to their local authority area. The specific questions I have are:

1.       Has Moray Council made a decision to object to a proposal to construct or operate a power generation scheme with a capacity in excess of 50 megawatts which requires Scottish Ministers' consent under section 36 of the Electricity Act 1989 in the period 31 January 2004 to 31 January 2014?

2.       If Moray Council has objected to a proposal to construct or operate a power generation scheme with a capacity in excess of 50 megawatts which requires Scottish Ministers' consent under section 36 of the Electricity Act 1989 in the period 31 January 2004 to 31 January 2014,

a.       What external resources were procured to represent the Council at (a) public local inquiry and (b) any other means to influence the decision of Scottish Ministers

b.      What Council resources were utilised to represent the Council at (a) public local inquiry and (b) any other means to influence the decision of Scottish Ministers

c.       what was the total cost of representation of such an objection at (a) public local inquiry and (b) directly to Scottish Ministers

1. 12/01081/S36 - Brown Muir Hill, Rothes - Dev. 0f 19 turbine wind farm and associated infrastructure - 21.12.12

08/01200/S36 - Dornell, Glenfiddich Estate - Construct and operate wind farm - 26.10.2009

2. In response we can confirm the following in relation to Dorenell as Brown Muir was withdrawn and therefore the question is not relevant to that development

a. We did not procure any external resources.

b. The application was dealt with by the Scottish Government through written submission, hearings and PLI sessions. The Legal Services Manager represented the  Council with input from the Director of Environmental Services, Principal Planning Officer and a Planning Officer were also involved in preparing and presenting the Council's case.
