FOI Request - Looked After Children

I am writing to make a request for information pursuant to Section 1(1) of the Freedom of Information (Scotland) Act 2002.  The information requested relates to children who are looked after by the local authority (within the meaning of s.17(6) of the Children (Scotland) Act 1995) and additional support needs under the Education (Additional Support for Learning) (Scotland) Act 2004.  I request the following information from the Council:

(a) The number of children looked after by your local authority (within the meaning of s.17(6) of the Children (Scotland) Act 1995);

(b) In respect of the numbers of children in (a) above, I seek the following information:
i. the number in respect of whom the authority has formed the view that they do not have additional support needs – having followed the procedures set out in s.1(1B) of the Education (Additional Support for Learning) (Scotland) Act 2004;

ii. the number in respect of whom the authority have considered whether they require a Co-ordinated Support Plan, in compliance with s.6(1A) of the Education (Additional Support for Learning) (Scotland) Act 2004; and

iii. the number who have a Co-ordinated Support Plan.

(b)(i) 116 as at 24/03/15.  This number takes into account the amendments made to the Education (Additional Support for Learning) (Scotland) Act 2004 by the Education (Additional Support for Learning) (Scotland) Act 2009 whereby “a child or young person has additional support needs if the child or young person is looked after by a local authority (within the meaning of section 17(6) of the Children (Scotland) Act 1995 (c. 36))” and “But where, in the course of identifying (in accordance with the arrangements made by them under section 6(1)(b)) the particular additional support needs of a child or young person who is looked after by a local authority (within the meaning of section 17(6) of the Children (Scotland) Act 1995 (c. 36)), an education authority form the view that the child or young person is, or is likely to be, able without the provision of additional support to benefit from school education provided to or to be provided for the child or young person, the above ceases to apply.”.
