FOI Request - Planning Applications - Section 17 of the Roads (Scotland) Act 1984

I refer to Planning Applications and section 17 of the Roads (Scotland) Act 198 which refers to security for private road works relating to housing,  In particular I would like to ask the following:

1. Can an applicant making a planning application for the construction of a single private dwellinghouse on a private road include in their application the offer of a fixed sum road bond for the making up and maintenance of that private road?  

2. If yes, would The Moray Council be willing to hold that road bond until payment needed to be made for the making up and maintenance of the private road?

Response 10-07-2015

1. The answer is no.  The procedure applicable for road bonds is set out in the Security of Private Road Works (Scotland) Regulations 1985.  The regulations apply where development will front or abut a private road that has not yet been constructed.  The regulations do not apply where the development will front or abut an existing road not of a standard acceptable to the local roads authority.
