I am making this request under the Freedom of Information (Scotland) Act 2002 and, where applicable, the Environmental Information (Scotland) Regulations 2004.

The request concerns planning application 26/00973/APP for change of use of former Kinloss Golf Course land to garden ground and erection of a post and wire fence and field gates at Wyvis View, 12 Fairway Heights, Kinloss.

We would be grateful for copies of the following recorded information held by Moray Council.

1. EP5 / Amenity Land designation

Please provide:

a) The recorded designation applying under the Moray Local Development Plan 2020 to the land subject to application 26/00973/APP.

b) Confirmation of whether the whole of the 1.859 hectares subject to the application is identified as Amenity Land under the MLDP 2020 proposals map, or whether only part is so designated.

c) If only part is designated Amenity Land, please provide the recorded area, boundary or map identifying the part concerned.

d) Any Council map, GIS record, plan or other recorded information showing the Amenity Land designation affecting the application site.

e) Any recorded Council guidance, assessment or other document held by the Council which identifies how Policy EP5 has been applied specifically to the land subject to application 26/00973/APP.

2. Kinloss Golf Course Masterplan

Please provide the relevant recorded information held by the Council identifying:

a) The area of land to which the Kinloss Golf Course Masterplan applies.

b) Any Masterplan plan, map or drawing showing the boundary of the Masterplan area.

c) Any recorded designation, proposed land use, open-space area, amenity area, pedestrian route, footpath or other route shown within the Masterplan area which affects the land subject to application 26/00973/APP.

d) Any recorded information identifying whether the land immediately surrounding the existing dwelling at Wyvis View, 12 Fairway Heights is intended to remain as open space, amenity land or land for pedestrian access under the Masterplan.

e) Any recorded correspondence or assessment held by the Council which specifically considers the relevance or application of the Kinloss Golf Course Masterplan to planning application 26/00973/APP.

3. Public access / pedestrian routes

Please provide any recorded information held by the Council identifying whether any part of the land subject to application 26/00973/APP is:

a) identified as a public footpath;
b) identified as a pedestrian route;
c) identified as land intended for public access;
d) subject to a planned pedestrian connection under the Kinloss Golf Course Masterplan; or
e) otherwise specifically identified by the Council as requiring continued public access.

If such a route or designation exists, please provide the relevant plan, map, policy or other recorded information identifying its location.

4. Fencing and field gates

a) Please provide any recorded Council policy, guidance, Masterplan provision or other document relied upon in assessing whether the proposed post-and-wire perimeter fence and field gates are acceptable or unacceptable in principle on the application site.

b) Please also provide any recorded information held by the Council identifying fencing requirements or restrictions arising from the Kinloss Golf Course Masterplan in relation to residential properties or garden ground within the development area.

5. Other approved fencing within the development

We understand that fencing and gates have subsequently been approved at a number of properties within the wider Kinloss Golf Course development.

Please provide, where held:

a) The planning application references for applications involving the erection of comparable fencing and/or gates at properties within the Kinloss Golf Course development.

b) The decision notices and relevant plans for those applications.

c) Any recorded planning assessment or officer report relating specifically to the principle of the fencing and/or gates in those applications.

This request is intended to obtain the recorded information held by the Council and is not intended to request personal information concerning individual householders.

6. Planning assessment of application 26/00973/APP

Please provide copies of any recorded documents, assessments, internal reports, consultation responses or other records which identify:

a) the specific policies and designations considered applicable to the proposed change of use to garden ground;

b) the specific policies, Masterplan provisions or designations considered relevant to the proposed amount of garden ground;

c) the specific policies, Masterplan provisions or designations considered relevant to the proposed perimeter fencing and field gates; and

d) any recorded assessment of whether the proposal would result in the loss of land identified as public open space, amenity land or land required for pedestrian access.
