Equality Impact Assessments
The Council, as a service provider and employer, has a duty under Section 149 of the Equality Act 2010 to consider how we can:
eliminate discrimination, harassment, victimisation and any other conduct not allowed under the Act;
advance equality of opportunity between those who share protected characteristic and those who don't;
foster good relations between these different groups.
This is known as the general public sector equality duty.
The Equality Act 2010 (Specific Duties) (Scotland) Regulations 2012 set out other specific legal equalities duties to make sure the Council meet their overall general duties. These include:
assessing the impact of any proposed new or revised policy or practice;
considering relevant evidence relating to people who share a protected characteristic (including any evidence received from that group);
taking account of the assessment when developing that policy or practice;
publish the results of any assessment within a reasonable time period;
making arrangements to review / revise the policy or practice.
This is done by using and Integrated Impact Assessment (IIA). An IIA assesses any potential equalities, human rights, children's rights and / or socio-economic impacts or disadvantage.
IIA's are presented with committee reports to inform the Council's decision making process.
