We refer to the above and request the following information from 26th October 2020 to date:

1. Confirmation that the road and footpaths at the locus have been adopted by the Local Authority
2. Details of, and documents relating to, inspection reports of the road and footpaths at the locus.
3. Details of, and documents relating to, repair reports of roads and footpaths at the locus.
4. Details of, and documents relating to, the risk category assigned to the road and footpaths at the locus.
5. Details of, and documents relating to, the level of priority for carrying out repairs to the road and footpaths at the locus.
6. Details of, and documents relating to, the criteria for assigning risk categories for roads and footpaths.
7. Details of, and documents relating to, the measurement of a defect requiring urgent, Category 1, repairs for roads and footpaths.
8. Details of, and documents relating to, the response time for repairing a defect requiring an urgent, Category 1, repair for roads and footpaths.
9. Details of, and documents relating to, the measurement of a defect requiring non-urgent, Category 2 or below, repairs for roads and footpaths.
10. Details of, and documents relating to, the response time for repairing a defect requiring a on-urgent, Category 2 or below, repairs for roads and footpaths.
11. Details of, and documents relating to, your system of inspection in respect of repair and maintenance of roads.
12. Details of, and documents relating to, previous complaints by residents, members of the public, or any other parties, in relation to the state of repair of the road and footpaths at the locus.
13. Details of, and documents relating to, the procedure for lodging complaints regarding defects in roads and footpaths and passing such details to the relevant department for action.

Response 04-10-2022

1) Not all the paths in this area have been adopted.
2) Regular inspections of the area are carried out by housing staff although these inspections are not recorded - information not held. Information that is not held falls under Section 17 of the Freedom of Information (Scotland) Act 2002 - Information not held.  
3) On 1 November 2021, a repair was reported to the Housing Service relating to footpaths in the locus of Fairisle Place, Lossiemouth. An inspection was carried out by an Estate Caretaker and a works order was raised for the clearance of moss and spray treatment in the area on 3 November 2021.   
4) The Housing Service do not assign risk categories to non-adopted footpaths - information not held. Information that is not held falls under Section 17 of the Freedom of Information (Scotland) Act 2002 - Information not held. 
5) Repairs to footpaths would either be classed as an emergency or necessary repair dependent of the level of risk posed to a tenant or member of the public. There are no specific timescales but the area would be made safe if there was an immediate safety risk.

9) See response to question 5. The officer raising the repair will make a judgement on whether an emergency or necessary repair is raised based on the level of risk the defect poses to a tenant or member of the public.
