Part 1: Interpretation
“1982 Act” means the Civic Government (Scotland) Act 1982
“2006 Act” means the Housing (Scotland) Act 2006
“the earlier period” means the three years between 10 October 2017 and 9 October 2020
“the later period” means the three years between 10 October 2020 and 10 October 2023
“decision” mean a decision to grant, refuse, continue or vary a licence.
“licensing committee” mean a body composed exclusively of elected members which is constituted for the purposes of determining licensing applications and supported by officers.
“officers” mean staff employed by the licensing authority.
“various licensing schemes” mean any licensing scheme operated by the Licensing Authority under the 1982 Act and the 2006 Act.

Part 1: General Requests
1. The number of applications received for a decision in a licensing scheme operated by the Local Authority within the terms of the 1982 Act or the 2006 Act. Please break this down into what the application was for (eg a new licence, renewal or variation of an existing licence) and also the various licensing schemes.

3. Have there been any hearings held by a body or person other than a licensing committee (such as an individual officer, or a Housing Decision Panel composed of officers)?
Part 2: Hearings not conducted by Licensing Committees
If the answer to question 3 is yes:
4. How many of the hearings referred to in question two were heard by a body or person other than a licensing committee? Please break this data down to each licensing scheme operated by the Licensing Authority under the 1982 Act and the 2006 Act for:
a. The earlier period
b. The later period
5. How is that body or person composed (eg is it an individual person empowered to conduct hearings, a body composed of both elected members and officers, or a body composed exclusively of officers)
6. What is the jurisdiction of that body or person? For example, can it only consider applications to vary, or can it only consider applications relating to one or more of the various licensing schemes operating under the 1982 Act or the 2006 Act.
7. Does that body or person meet exclusively remotely, exclusively in person or a mixture of the two?
8. Is there an internal right of appeal of the decision of that body of person eg to a licensing committee or senior manager?
9. Are there any governance documents which must be considered or followed by that body or person in making their decision. For example, are there Standing Orders which must be followed?
10. For questions 5-8, has there been any change in either the earlier period or the later period?
11. Has there been an appeal to the Sheriff following a decision of that body or person? If so please provide a copy of the note(s) of decision where that exists and is not publicly available.
