FOI Request - Modular Units

Under the Freedom of Information Act Scotland (FOI) The Teddy Bear Group would request the following information:

1. We would like to understand why it took 12 days for us to be informed of the outcome of the meeting held on the 6th March?

2.  We would like to ask for a copy of the minutes pertaining to the decision regarding the modular units?

3. We would like to know if councillors were involved in the decision process regarding the sale of the modular units and if so which councillors?

4. We would like to know how the decision was made and what factors contributed the decision outcome?

5. We would like to know which bids were successful, why they were successful and why our bid failed?

Response 12-04-2024

1. Following the decision by Council the priority is to ensure the transaction progresses with the preferred bidder; unsuccessful bidders are informed once it is clear the transaction will progress.

2. The minute for the meeting is not available until after the next ordinary Council meeting on 22 May when the draft minute will be approved. Thereafter the minute will be available on the Council website. Therefore this information is exempt under Section 27 (1) of the Freedom of Information Act - Information intended for future publication within 12 weeks of the request.

3. A report outlining the outcome of the closing date for the units was presented to the Council meeting on 6 March with a recommendation. The Council meeting then made the decision.

4. The decision was made at the Council meeting. The report outlined the proposals submitted at the closing date and considered which proposal represented Best Value to the Council.

5. The transaction has not concluded yet, therefore it is not in the public interest to disrupt the awarding of a contract. Disruption might ultimately prevent the contract being awarded, thus impacting on the public purse, and delaying the contracted service/item being provided. This information is exempt under Section 33(1)(b) of the Freedom of Information Act - Commercial Sensitivity.

The proposal accepted by Council was deemed to demonstrate best value to the Council.
