Regarding a previously removed bollard at Burghead Harbour.

Please confirm/provide the following:

1. Who is responsible for inspecting Burghead Harbour? Is it the Harbour Master?

2. How often is Burghead Harbour inspected?
a) It is a driven or walked inspection?

3. When was the bollard removed and by whom? We understand it was damaged by a council department which led to its removal.

4. What temporary measures (if any) were put in place following the removal of the bollard to ensure safety for passersby and road users? Who carried out these temporary repairs?

5. When was the road surface at Burghead Harbour inspected prior to 14th July 2025? Were any defects noted?

6. When is the road surface at Burghead Harbour next due to be inspected after 14th July 2025? If this has already taken place, were any defects noted?

7. Please provide any documentation you may hold in relation to the reporting of our client’s accident.

Response 21-08-2025

1. The Harbour Master manages the inspection process for the harbours.

2. The harbour inspection is carried out three times a week in accordance with the operational procedure.

3. The bollard was removed in early July 2025 so a replacement could be sought.

4. The flap, which prevents the empty bollard hole becoming a hazard, was closed when the bollard was removed.

5. Inspections were conducted at Burghead Harbour on 7, 9, 11 and 14 July 2025 prior to the reported incident. No defects associated with the bollard flap were noted during the inspection process. A specific additional inspection of the bollards was undertaken on 9 July 2025. It was noted the flap was closed at this time.

6. The harbour has continued to be inspected in accordance with the operational procedure since 14 July. No defects have been reported with the bollard flap assembly.
