Under the Under the Tobacco and Primary Medical Services (Scotland) Act 2010 and Health (Tobacco, Nicotine etc. and Care) (Scotland) Act 2016, please can you tell me:

1. for each year of the last 10 years to March 2026

a) how many fines have been issued
b) the reason for the fine
c) their value
d) and to whom (the company owner and/or company name).

2. Please can you also tell me how many banning orders have been made over the same time period and to whom (the company owner and/or company name).

a) Please can you provide the month and year of action taken.

d) Disclosure of the requested information could prejudice commercial interests and so it is exempt under section 33(1)(b) of the Freedom of Information (Scotland) Act 2002, commercial interests. The public interest was considered; we would not want to hurt business prospects with enforcement at the fine level. If more serious enforcement were raised then releasing names of companies into the public domain would be considered.
