Having recently submitted a FOI request in regards to insurance document wording for MV Selkie which was rejected by Moray Council. My request was to get a copy of the wording of Insurance policy for Selkie. I requested just a copy of the policy word for word and NO price or any other sensitive detail. This was rejected by Moray Council due to it being commercially sensitive. On the request I only ask for the policy wordings.

Following your request for a review (our review ref: 101003989815) of your Freedom of Information (FOI) Request – Insurance Document Wording (our ref: 101003969255) – a review meeting was held on 14th May 2026. In attendance were the Information Governance Manager and Data Protection Officer; Head of Operations & Environment; Solicitor; and Information Co-ordinator.
Your FOI Request (101003969255) from 26th March 2026 was discussed.
In our response we had applied the exemption under Section 33(1)(b) of the Freedom of Information (Scotland) Act 2002 - Commercial Sensitivity.
We maintain that this exemption was applied correctly and that this information is indeed commercially sensitive. The public interest test was discussed, and we maintain that it is not in the public interest to put documents into the public domain that might impact on the validity of any such insurance or future insurance claims, as this would ultimately negatively affect the public purse.
We therefore uphold our previous response.
