Could you please show me the documentation that defines Trust 1 as a public trust.  As far as I am concerned the Declaration of Trust is exactly that a declaration that the Grant Park will maintained in a specific manner ie by the local authority in the public interest (Common Good).  The ownership ie Forres Council does not change.

Please find enclosed an extract from a Counsel Opinion in 1996 HERE. The opinion relates to East Lodge in particular but applies generally to Grant Park as both were part of the same legal title at that time.

Page 1 of the extract provides confirmation of the Moray Council's position that Grant Park and the buildings on it form part of a Public Trust.

Therefore the Declaration of Trust (Provided HERE) and the extract attached above will provide the information requested.
