Thank you for your response however the informative you have provided is inaccurate. My understanding is that public bodies are obliged to provide accurate information in response to FOI requests.

For example - There were more than 15 pupils that left Logie Primary School in 2024.

Following your request for a review (our ref: 101003771144) of your Freedom of Information (FOI) Request - Logie Primary School Investigations (our ref: 101003741640) - a review meeting was held on 1st May 2025. In attendance were the Information Governance Manager and Data Protection Officer, Depute Chief Executive (Education, Communities & Organisational Development), Business Support Team Manager, Senior Solicitor, Solicitor, and Information Co-ordinator.

Your FOI Request (101003741640) from 10th March 2025 was discussed.

We looked at the original questions you posed and our responses. Please see below our findings:
• Regarding question 1, we uphold the application of Section 33(1)(b) of the Freedom of Information (Scotland) Act 2002 (FOISA) - Commercial Sensitivity. The public interest test was considered and believed that releasing this information would have a negative impact on the public purse in the future.
• Regarding question 5, we uphold the previous response, the application of Section 30(c), and do not consider that the information should be released nor that the public interest has changed since previous consideration.
• Regarding question 6, we confirm that no minutes were taken, therefore we uphold our response of “Not held and the application of exemption Section 17 of the Freedom of Information (Scotland) Act (FOISA) 2002 - Information not held.”
• Regarding question 7, we uphold our previous response of this information being exempt under Section 18 of FOISA - neither confirm nor deny that this information is held. Furthermore we confirm that, if it is held, it would be likely to be exempt under Section 38(1)(b) of FOISA - Personal Information.
• Regarding question 9, we apologise for the information having been given in a misleading way. The school roll information is publicly available; for ease of reference please find a link to the web page here: http://www.moray.gov.uk/downloads/file159781.pdf  and, page 7 may be of particular interest.
In order to be helpful we can provide the below clarification:
• In 2020 the school roll was 33
5 children left in P7 and 5 arrived in P1 the next year
• In 2021 the school roll was 37 so there was an increase in the roll across the rest of the school of 4
10 children left in P7 and 11 arrived in P1
• In 2022 the school roll was 42 so there was an increase in the roll across the rest of the school of 4
3 children left in P7 and 7 arrived in P1
• In 2023 the school roll was 42 so there was a decrease in the roll across the rest of the school of 4
4 children left in P7 and 1 arrived in P1
• In 2024 the school roll was 16 so there was a decrease in the roll across the rest of the school of 23

The review meeting also discussed your additional questions and, as part of the FOI Review, have provided the following responses:
1. We confirm that the number of staff that have left Logie Primary School in the last 6 years is: 7, please note this will include staff on temporary contracts such as NQTs.
2. We confirm that there were no minutes of the public meeting at Edinkillie Hall on June 11th; information that is not held is exempt under Section 17 of FOISA - Information not held.
3. We confirm that Section 17 of FOISA is applicable; Information not held.
