Land / Property Acquisition and Compensation

Elgin Western Link Road:

Land / Property Acquisition and Compensation

The Moray Council will need to acquire various portions of land in order to deliver the scheme and this will unfortunately  include the demolition of two properties. Another is significantly affected and the Council has agreed to acquire this too.

The Council's intention is to negotiate with owners wherever possible, however for a scheme of this scale and with the number of landowners involved, it is essential that procedures are in place to ensure the scheme can be delivered successfully. Consequently the Council will be following the Compulsory Purchase Order (CPO) process as recommended by the Scottish Government. The CPO will only be used if negotiations fail.

Land and property owners will be engaged with at an early stage and also throughout the detailed design stage. It is hoped that through this the impact on owners can be minimised.

The Scottish Government has recently updated its guidance on the CPO process for owners, tenants and occupiers and a copy of this can be found here.
