To support an intelligence led approach to Trading Standards enforcement locally and nationally.

The legal basis/bases for collecting the information is:

• Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller (i.e. Moray Council).

Where sensitive/special category data is being processed (e.g. health information, criminal convictions etc.) the legal basis/bases for collecting the information is:

• Processing is necessary for reasons of substantial public interest and is authorised by domestic law proportionate to the aim pursued.

The 'reason of substantial public interest' relates to:

Administration of justice and parliamentary purposes

The criminal conviction data is being processed under the following legal condition:

Preventing or detecting unlawful acts

Your information will be shared with the following recipients or categories of recipient:

(1) Local authorities
(2) Police
(3) Intellectual Property Office
(4) Food Standards Scotland
(5) Financial Conduct Authority

The personal data has originated from a third party. This data includes:

Free text field to capture any relevant information on the subject, e.g.
Vehicle information, associates, criminal record numbers, alleged offences, finance details, directorships, photographs, passport details, trading activity.

The third party data may originate from these sources:

Public, traders, other local authority Trading Standards, Police & and other law enforcement bodies.

Note - we will add intelligence to the database as we discover it in the course of enquiries or marketplace monitoring.
